Terms and conditions of sale

Conditions of granting

 
  • Only unopened goods in resalable condition can be accepted;
  • Transport costs will be charged to the customer;
  • Exchange or credit note is possible if and only if the order was placed less than one year ago;
  • The expiry date* must be greater than 3 months.

If the customer is eligible, they will be entitled to

        A credit note: 50% of the purchase price.

        Or 

         An exchange:

    • Same product: No impact on the invoice. However, the delivery costs will be added to your next invoice.
    • Different product: Discount on the next invoice of 50% of the purchase price of the old product.

Procedure


1.Send an email to order@lepivits.be :including

  • The name of the product;
  • The number of products;
  • The batch number;
  • The expiry date.

2. Return the products to the following address     Lepivits 
                                                                                        4 Avenue Franklin - Unité 16 
                                                                                        1300 Wavre

3. Upon receipt of your return :

    New products will be returned to you;

    Or

    The credit note will be issued within 5 working days.

*If the Best Before Date is less than 3 months, no refund or exchange will be possible.

Art. 1 - Scope of application

All our deliveries and services are subject exclusively to these general terms and conditions of sale, of which the purchaser is deemed to have taken note.

Art. 2 - Offer and conclusion of contract

Our price offers and promotions will be sent to you by e-mail. All our prices are expressed in euros. Delivery times are indicative (48h - working days) and are not binding.

Art. 3 - Transport

In general, unless otherwise indicated, orders will be delivered by Bpost Belgium. Delivery times may vary depending on the buyer's request. The delivery costs will be paid by LEPIVITS provided that the buyer orders a minimum of 100€ of LEPIVITS products. Unless otherwise stated, the buyer who wishes an Express shipment, will have to pay the additional costs.

Art. 4 - Guarantee

The quality and weight of the products sold are checked and guaranteed when they leave our warehouses. Under penalty of nullity, any complaint about our supplies must be made in writing within 30 working days after receipt of the goods. The buyer must examine the goods at the time of delivery and, in the event of a complaint, must take all necessary steps to demonstrate his good faith.

Art.5 - Responsibility

We do not accept any liability for facts and damages which may result from the use of our products or from a failure by the users of our products to observe local regulations and standards. Whatever the cause of the complaint, our guarantee is limited, at our discretion, to the free replacement or reimbursement of the price of the goods recognised as defective or not in conformity, to the exclusion of all damages.

Art. 6 - Force majeure

Cases of force majeure and, in general, all circumstances which prevent, reduce or delay manufacture or shipment, give us the right, as the case may be, to reduce, terminate or suspend our commitments. The following circumstances in particular shall be considered as such: war, riots, strikes, lockouts, epidemics, fire, unavailability of equipment, raw materials or modes of transport and any restrictions imposed by the public authorities.

Art. 7 - Payement

Unless explicitly stated otherwise, the first order is to be settled before the goods are dispatched. Subsequent orders are payable within 30 days after the invoice date and in the currency indicated on the invoice. Despite our ability to make use of the law of 2.08.2002 on the fight against late payment in a commercial application, all sums not paid on the due date will automatically and without notice bear interest of 1% per month. Also we can legally demand without notice damages equal to 10% of the invoice amount. The goods are payable only via the IBAN account indicated at the bottom of the invoice (followed by the BIC number) and included in this document.

Art. 8 - Insolvency and change of circumstances

In the event of a reduction in the solvency of the purchaser or a change in his legal or financial situation, we reserve the right to terminate the current contracts or to demand guarantees. Failure to pay on the due date shall entitle us to terminate the current contracts by operation of law.

Art.9 - Reservation of ownership

The delivered goods remain our property until full payment has been made. In the event of non-payment by the customer, we are entitled to take back our goods upon written notice.

Art.10 - Applicable law - Jurisdiction

Belgian law is applicable to all our sales even if the buyer is established abroad. In case of dispute, the courts of Brussels shall have exclusive jurisdiction. However, we reserve the right to bring the dispute before the courts of the buyer's place of residence.
